La Cancillería de de Paraguay puso en marcha el proceso de formación del tribunal arbitral permanente del Mercosur, que funcionará en Asunción. Según el Protocolo de Olivos, firmado en Buenos Aires en febrero de 2002 en lugar del de Brasilia, de 1991, el tribunal arbitral se encargará de dirimir las controversias entre los estados partes del bloque: la Argentina, Brasil, Paraguay y Uruguay.
“Antes de que entrara en vigencia el Protocolo de Olivos existían solamente tribunales arbitrales ad hoc, que se formaban para tratar un tema concreto y, una vez resuelto, dejaban de existir”, afirmó el viernes el ex senador y asesor de la Cancillería Evelio Fernández Arévalos.
El nuevo organismo se incorpora al que ya existe. A fines de mes debe estar listo un reglamento para que entre en funciones en treinta días más.
El tribunal arbitral, que funcionará en Asunción con una Secretaría Permanente, oficiará de “Alzada (segunda instancia) de los tribunales ad hoc solamente en materia jurídica, y no para juzgar hechos, para que haya una interpretación uniforme de los tratados", agregó Arévalos.
Añadió que tendrá carácter de “primera y única instancia” y que las partes afectadas del bloque, al que Bolivia, Chile y Perú se han adherido con acuerdos comerciales, pueden apelar al tribunal formado para cada caso o al permanente.
También “tendrá la facultad de dictar medidas cautelares y de urgencia y de valuar consultas de los países sobre algunas cláusulas del tratado”, ahondó Arévalos.
El funcionario de la Cancillería encabeza un grupo de asesores que tendrá a su cargo la selección de los candidatos que propondrá el Gobierno de Asunción.
